Otherwise Charney Commercial warranty will be voided. c) Prove that the equipment has not been damaged, altered, or misused. d) Prove that equipment was properly installed, adjusted, operated, and maintained in accordance with national, state, and local codes for commercial kitchens. e) Charney Commercial Sales shall not be liable, whether in contract or in tort, or under any other legal theory, for loss of use, revenue or profit, or for substitute use of performance, for incidental, indirect, or special, or consequential damages, or for any other loss of cost of similar type.
