All Grainger products are covered by applicable warranties and limitations of liability set forth in Grainger?s standard terms and conditions in Section I. Customer?s sole remedy for any breach of these Additional Export Terms or Grainger?s standard terms and conditions of sale shall be limited to the price paid by Customer for the product. In no event shall Grainger be liable for any consequential, incidental, special, or punitive damages, or for any loss of profit, revenue, data, or use, however caused and regardless of the theory of liability, arising out of or in connection with this agreement, even if Grainger has been advised of the possibility of such damages. All Export Sales are made F.O.B. Origin, and title and risk of loss passes to Customer upon delivery to the carrier. Any disputes arising out of or related to these Additional Export Terms or the export of Grainger products shall be subject to the exclusive jurisdiction of the U.S. federal courts in Chicago, Illinois. No waiver by Grainger of any or all of these Additional Export Terms shall be construed as a waiver of any other provision of these terms and conditions, nor shall any such waiver be deemed a continuing waiver unless otherwise expressly stated in writing.
