GRAINGER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY RELATED TO THIS AGREEMENT, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF GRAINGER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GRAINGER'S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL BE LIMITED TO THE PURCHASE PRICE PAID FOR THE PRODUCT GIVING RISE TO SUCH LIABILITY. Grainger Product warranties are valid only if the Product is used in accordance with its intended purpose and all applicable laws, regulations, and requirements. 5. Warranty. This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. These Additional Export Terms, together with Grainger's Standard Terms and Conditions in Section I, constitute the entire agreement between the parties and supersede all prior or contemporaneous agreements or representations, whether oral or written, relating to the subject matter of this Agreement. 8.
