Washington State University Surplus Stores     Item Description: HP Electroink Custom Color PMS-130-C for Indigo Series Presses 3000 & 4000 WSU Surplus is offering new in the box HP ElectroInk for sale.  The box contains nine (9) cans of ink and one (1) calibration can.  This ink was new in the box when it arrived at WSU Surplus from Publications.  We opened the box to verify the contents were in good condition and verify count. Please Read the Following Terms and Conditions   A,  GENERAL INFORMATION: The description of the property given is based on the best available information to WSU.    WSU MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, WHETHER EXPRESS OR IMPLIED (EITHER IN FACT OR BY OPERATION OF LAW) WITH RESPECT TO THE PROPERTY, INCLUDING BUT NOT LIMITED TO, THE ACCURACY OR COMPLETENESS OF THE DESCRIPTION OF THE PROPERTY, OR THAT THE PROPERTY WILL MEET THE BIDDER'S NEEDS OR BE FREE FROM DEFECTS.  WSU EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES AS TO THE PROPERTY'S MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE, AND NO CLAIM BY BIDDER SHALL BE CONSIDERED FOR ALLOWANCE OR ADJUSTMENT OF THE SALES PRICE, OR FOR RESCISSION OF THE SALE, BASED ON BIDDER’S FAILURE TO INSPECT THE PROPERTY.  THE PROPERTY IS OFFERED FOR SALE TO THE HIGHEST BIDDER "AS IS, WHERE IS."   WSU reserves the right to reject any and/or all bids in the best interest of WSU. All sales are final, no refunds or exchanges.   If a Buyer is participating in an auction, Buyers are responsible for their purchases when the auctioneer says, "Sold."  The accepted bid at an auction is an oral contract and is legally binding.  All sales are final.  The university is not responsible for any damage to or loss of items after the bid is awarded.   Whether items are acquired through auction or pre-priced sale, removal and use of the property is the sole responsibility of Buyer. University owned hand trucks and carts may be used by Buyer for loading property on the General Storage Building premises, if available, and WSU employees will assist in loading with forklifts, if available, but only under the condition that Buyer holds the university harmless for any damages.   Absentee bids, proxy bids, and firm written bids may be submitted to the auctioneer prior to the start of the sale.   B.   PAYMENTS: Payment can be made via: Visa, MasterCard, PayPal or Direct Wire Transfer. (please call for more information on Direct Wire Transfers and PayPal).   C.   SALES TAX: 1. Live Auctions, Pre-Price Sales and Sealed Bids: Washington State Destination Tax rules will apply. Exceptions: Buyer produces appropriate resellers' permits and certification. Titled vehicles and titled equipment. 2. Online Sales: Sales tax will not be collected unless buyer resides in the state of Washington, Washington State Destination Tax rules will apply. 3. Agencies: Non-Profit organizations with a 501(c)(3) or (7) registration on file with Surplus Stores will not be charged sales tax.   D.  SHIPPING, RECEIVING AND REMOVAL 1. Live Auctions and Pre-Priced Sales: All items must be removed by the successful bidder by 4:00 PM the day of the sale. Items may be removed on a later date by previous agreement with the Surplus Supervisor. To cover additional administrative costs of completing a sale after the auction or pre-priced sale, if Buyer does not fully pay for the item by 3:00 pm on the day of the auction or pre-priced sale, an additional $25.00 fee will be charged before items can be picked up. Up to $25.00 per day may be assessed as a storage fee for items left more than five (5) university working days. Items cannot be picked up until fees have been paid. WSU Surplus reserves the right to resell an item if that item has been paid for and not removed within ten (10) university working days of the close of sale. WSU Surplus also reserves the right to have a vehicle towed, at the buyer's expense, if the paid vehicle is not removed within ten (10) university working days of the receipt of payment. In addition, WSU Surplus may block buyer from participating in future auctions and sales. 2. Online Sales: Online item(s) successfully bid on must be paid for in full within ten (10) calendar days or all of Buyer’s rights to the property are automatically revoked. WSU Surplus will either offer the item to the next highest bidder or resell the item(s), whichever is in the best interest of WSU Surplus. In addition, WSU Surplus may block buyer from participating in future auctions and list them as a "no pay" account or client with eBay or other online selling agencies. 3. Shipping and Handling: Buyer must pay the cost of shipping. WSU will ship all items at buyer’s expense unless noted in sale listing that shipping is buyer’s responsibility. All items will be shipped by WSU Surplus are shipped at buyer’s expense from zip code 99164 via FedEx, UPS or USPS. All items over 150 pounds shipped via motor freight. WSU Surplus will ship items under 150 pounds worldwide. Items larger than 150 pounds will be restricted to Continental US, Canada and Mexico. All shipping costs will be the responsibility of the winning bidder. Please consider these costs when submitting your bid. WSU Surplus will charge a $10.00 handling/packaging fee for all items under 150 pounds. For Items over 150 pounds Buyer will be charged a $25.00 handling/pallet fee. 4. Online Sales for Local Pickup: Online sales items designated as “local pick-up only” will be the Buyer’s responsibility to prepare items for shipping and/or to make shipping arrangements. WSU will not always be available or capable to provide loading assistance. If the buyer pays for but does not pick up their item(s) within five (5) calendar days after receipt of payment, buyer will be charged up to $25 per day per listing for storage fees. Items cannot be picked up until fees have been paid. WSU Surplus reserves the right to resell an item if that item has been paid for and not removed within ten (10) university working days of the close of sale. Sealed Bids: It is the buyer’s responsibility remove and haul purchased items or to prepare items for shipping and to make shipping arrangements. WSU will not always be available or capable to provide loading assistance. If buyer does not make payment within 30 days of invoice being posted in BRS system or within 30 days of invoice date, buyer forfeits item and WSU will offer to the next highest bidder or resell the item(s), whichever is in the best interest of WSU Surplus Stores. If the buyer pays for but does not pick up their item(s) within five (5) calendar days after receipt of payment, buyer will be charged up to $25 per day per listing for storage fees. Items cannot be picked up until fees have been paid. WSU Surplus reserves the right to resell an item if that item has been paid for and not removed within ten (10) university working days after receipt of payment. E.   MEDICAL EQUIPMENT TERMS The sale of this item may be subject to regulation by the U.S. Food and Drug Administration and state and local regulatory agencies.  If so, do not bid on this item unless you are an authorized purchaser.  If the item is subject to FDA regulation, WSU Surplus will verify your status as an authorized purchaser of this item before shipping of the item.   WSU Supports environmentally appropriate use and reuse of items it sells.
