This part is used in HUTTINGER Generators PFG 1000 3X400V RS, 2500 3X400V RS, & 5000 3X400V RS TERMS AND CONDITIONS TRUMPF manufactures and sells metals-fabricating equipment and industrial lasers in the United States. In our day-to-day business, we come into possession of discounted goods such as customer returns, used parts and tooling, trade-ins, and overstock or discontinued items that make their way to our eBay store where they are offered to you AS IS, WHEREIS without warranty, but at significant savings from full-price retail. The goods have not been inspected, tested, refurbished or repaired by Seller. THE LIMITATION OF LIABILITY SET FORTH HEREIN SHALL OPERATE ON ANY CLAIM(S) OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, INJURY TO PERSONS OR PROPERTY) BASED ON CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE OR STRICT LIABILITY) OR ANY OTHER LEGAL THEORY, EVEN IF SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTICE OF CLAIMS: Buyer shall inspect the Goods upon receipt and shall notify Seller in writing of any claims for shortage or delivery of the wrong Goods within 30 days of receipt. Failure of Buyer to give written notice of a claim within the time period shall be deemed to be a waiver of such claim. LIMITATION OF ACTIONS. No action for breach of any term of this contract of sale or any other duty of Seller with respect to these Goods may be commenced more than one (1) year after shipment of the Goods. FORCE MAJEURE. Seller shall not be liable for or in breach of or default under this contract of sale on account of any delay or failure to perform as a result of any causes or conditions that are beyond Seller’s reasonable control that Seller is unable to overcome through the exercise of commercially reasonable diligence, including by not limited to fire, explosion, flood, storm or other acts of God, war, embargo, strike, riot, or the intervention of any government authority. WORK AND SAFETY REGULATIONS; INDEMNIFICATION. It is the responsibility of Buyer to know, understand and comply with the work and safety laws and regulations in effect and governing Buyer’s use of Goods sold hereunder. Seller does not by operation of this contract of sale assume any responsibility for or undertake any liability for Buyer’s performance under or compliance with such laws and regulations. Buyer assumes all risk and agrees to indemnify and hold harmless to the fullest extent permitted by law, Seller, and any of its board, officers, employees, parents, subsidiaries, affiliates or agents from and against any liability arising from any after-purchase actions of Buyer, including without limitation, any injury, disability or death of workers or employees caused by or in any manner incurred because of the misuse, abuse, or modification of Goods by Buyer after delivery. BUYER’S OBLIGATION HEREUNDER IS IN NO WAY LIMITED BY ANY PROTECTION AFFORDED IT UNDER WORKERS’ COMPENSATION ACTS, DISABILITY BENEFITS ACTS, OR OTHER EMPLOYEE BENEFITS ACTS. GOVERNING LAW. The validity, interpretation and performance of this contract of sale and all claims of any kind whether in contract, tort or otherwise, concerning, arising or relating hereto, shall be governed by the laws of the State of Connecticut, excluding such State’s conflict of law principles
