Payment in full must be received prior to shipping. Fees Prices do not include any federal, state or local taxes, which are in addition to the purchase price and must be paid by the Purchaser. Any and all foreign duties and taxes are the responsibility of Purchaser. Unless Purchaser furnishes PMS with a tax exemption certificate, any sales, use, excise, or other similar tax, where applicable, shall also be the responsibility of Purchaser and may, at the election of PMS, be added to the quoted purchase price and invoiced by PMS to Purchaser. The failure of PMS to invoice such taxes does not excuse the Purchaser from responsibility for paying necessary taxes. Machinery and Equipment Some machinery and equipment is located at Fortune 100 Manufacturing Facilities. Most of the machinery and equipment located at these Facilities is disconnected and cannot be seen under power. Unless specifically listed in writing by PMS, all machinery and equipment uses 3 Phase power. All machine sales are subject to machine availabilty. Loading/Freight Charges All rigging, insurance and freight charges are the responsibility of the Purchaser unless agreed by PMS and Purchaser in writing. A qualified rigger with a minimum of $2,000,000 liability insurance must perform all removal of machinery or equipment. No Purchaser will be allowed to load their own machinery or equipment unless proof of insurance is submitted prior and all other factory requirements are met. Loading dock hours are 7:00a.m.-2:00p.m. Monday-Friday. Unless specifically stated in writing by PMS, all freight carriers must use flat bed truck only. No skidding or crating of machinery or equipment will be performed by PMS. Inspection Upon reasonable notice to PMS, Purchaser shall have the right to inspect the equipment prior to shipment. All inspections must be approved by manufacturing facility and occur during the hours of 7:00a.m.-2:00p.m. Monday-Friday. Purchaser must wear OSHA approved steel-toed leather soled shoes, protective eye wear with side shields, long pants and not have any jewelry exposed. Refunds and Returns Purchaser agrees that its acceptance of the machinery or equipment tendered shall constitute an acknowledgement by Purchaser that such machinery or equipment satisfies any and all obligations by PMS. Purchaser may not revoke its acceptance for any reason whatsoever unless a return privilege has been provided in writing by PMS. With return privileges, PMS reserves the right to either repair the machinery or equipment at sellers expense or refund the Purchaser provided machinery or equipment is received in the same condition as shipped, freight prepaid by the Purchaser.
