All items should be inspected prior to purchase. MACHINE USE AND SAFETY: Buyer acknowledges that the goods described herein are pre-owned, used goods which were neither designed nor manufactured by the Seller; nor has the Seller knowledge of, or control over, the prior use or misuse of said goods; nor does the Seller have control over the future application of these goods by the Buyer. It is the Buyer or (user's) responsibility to provide proper safety devices and equipment to safeguard the operator from harm for any particular use, operation or setup, and to adequately safeguard the Equipment, machine or machines and to conform to federal, State, and Local Government Safety Standards and all Industry Safety Standards. INDEMNIFICATION: The buyer acknowledges that the goods covered by this instrument and provided by the seller are goods, neither designed nor manufactured by the seller. Specifications as to the equipment are correct to the best of the sellers knowledge and are solely intended as a guide and not a representation by the seller. As the seller does not know the specific application of the equipment then the buyer agrees to indemnify and hold harmless Seller of any and all claims or liabilities resulting from the use of this equipment or accidents caused by the failure of the buyer, his or her employees, or agents to follow instructions, warnings, or recommendations available from the original manufacturer, or to comply with federal, state and local laws applicable to such equipment including the occupational safety and health act of 1970. RIGGING: Any and all rigging charges required to load, unload or move the equipment to or from transport vehicles between the buyer and seller or any of the seller's locations is the responsibility of the buyer unless other arrangements have been agreed to in writing at the time of purchase. It is also the buyers responsibility to verify that the rigger has adequate insurance in the event that equipment becomes damaged during the rigging process. FREIGHT & Insurance: All freight charges incurred between the buyer and the seller are the buyers Expense and responsibility, and any insurance required on the equipment is at the buyers expense and responsibility . It is the buyers responsibility to acquire the above services from a responsible insured freight hauler, and determine the amount of insurance required on the equipment being shipped. In the event that equipment becomes damaged it is the buyers responsibility to file claim with the freight hauler and or insurance company. when the equipment leaves the sellers dock or location of origin it becomes the property and responsibility of the buyer. MACHINERY UNCLAIMED AFTER PURCHASE: Any and all machinery that is purchased and left at this facility, namely Oklahoma Gage & Supply located at 3200 Charles Page Blvd in Tulsa, Oklahoma needs to be removed within 72 hours of purchase in order to free up needed storage space. If other arrangements are made the agreement must be in writing and signed by both parties with final approval made by Dave Akers of Oklahoma Gage & Supply. Any equipment left over 72 hours will be subject to a $50.00 dollar daily storage charge before the equipment can be reclaimed. The buyer of said equipment is responsible for all rigging and freight charges to facilitate the removal of equipment from storage. Equipment left over 30 days will be subject to public sale in order to satisfy storage fees incurred. Oklahoma Gage & Supply will not be responsible for equipment left at their facility from fire, theft, or any other intentional or accidental damage including any acts of God. The buyer is totally responsible for his or her equipment and should obtain insurance against any of the occurances mentioned above. in order to facilitate the transaction the seller can and will offer assistance to the buyer in locating local contacts for rigging and freight hauling, and to try and obtain the best rates for the services required, however it is still the buyers responsibility to comply with the terms as they appear above.
