This part was only used for test. Selling AS-IS. This part is used in TRUMPF automation machines LiftMaster, LiftMaster Compact, & Load Master. TERMS AND CONDITIONS TRUMPF manufactures and sells metals-fabricating equipment and industrial lasers in the United States. In our day-to-day business, we come into possession of discounted goods such as customer returns, used parts and tooling, trade-ins, and overstock or discontinued items that make their way to our eBay store where they are offered to you AS IS, WHEREIS without warranty, but at significant savings from full-price retail. The goods have not been inspected, tested, refurbished or repaired by Seller. We use the following visual rating system to describe these goods: "Excellent" appears cosmetically close to new with very little use; "Very Good" shows blemishes consistent with use; "Good" is cosmetically blemished, by appearance could use some maintenance. Such descriptions are subjective approximations only and do not create warranty. As Buyer, you are solely responsible for determining if the purchase of goods AS IS, with no warranty and no returns, is right for you. Standard Terms & Conditions for E-Bay Sales ACCEPTANCE. Buyer alone is responsible for the decision to purchase the Goods without inspection, AS IS, with no warranty and no returns. PRICES. All prices are in U.S. currency and subject to all applicable federal, state and local taxes. Any taxes shall be paid by the Buyer in addition to the quoted purchase price. PAYMENT; NO CANCELLATIONS: Seller gladly accepts PayPal. Goods will not ship until cleared payment in full is received. Sales are not subject to cancellation. If payment in full is not received within 72 hours of purchase, Seller may relist the Goods or offer the Goods to the next highest bidder. IN NO EVENT SHALL SELLER HAVE ANY LIABILITY FOR EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR LOST PROFITS DAMAGES (INCLUDING BUT NOT LIMITED TO LOST SALES, LOST OPPORTUNITIES, LOST MARKET GROWTH OR LOSS OF FUTURE MARKET SHARE) ARISING OUT OF, CONNECTED WITH, OR RESULTING FROM THE PERFORMANCE OR BREACH OF THIS CONTRACT OF SALE OR ANY OTHER DUTY OF THE SELLER WITH RESPECT TO THE GOODS. THE LIMITATION OF LIABILITY SET FORTH HEREIN SHALL OPERATE ON ANY CLAIM(S) OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, INJURY TO PERSONS OR PROPERTY) BASED ON CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE OR STRICT LIABILITY) OR ANY OTHER LEGAL THEORY, EVEN IF SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTICE OF CLAIMS: Buyer shall inspect the Goods upon receipt and shall notify Seller in writing of any claims for shortage or delivery of the wrong Goods within 30 days of receipt. Failure of Buyer to give written notice of a claim within the time period shall be deemed to be a waiver of such claim. LIMITATION OF ACTIONS. No action for breach of any term of this contract of sale or any other duty of Seller with respect to these Goods may be commenced more than one (1) year after shipment of the Goods. FORCE MAJEURE. Seller shall not be liable for or in breach of or default under this contract of sale on account of any delay or failure to perform as a result of any causes or conditions that are beyond Seller’s reasonable control that Seller is unable to overcome through the exercise of commercially reasonable diligence, including by not limited to fire, explosion, flood, storm or other acts of God, war, embargo, strike, riot, or the intervention of any government authority. WORK AND SAFETY REGULATIONS; INDEMNIFICATION. It is the responsibility of Buyer to know, understand and comply with the work and safety laws and regulations in effect and governing Buyer’s use of Goods sold hereunder. Seller does not by operation of this contract of sale assume any responsibility for or undertake any liability for Buyer’s performance under or compliance with such laws and regulations. Buyer assumes all risk and agrees to indemnify and hold harmless to the fullest extent permitted by law, Seller, and any of its board, officers, employees, parents, subsidiaries, affiliates or agents from and against any liability arising from any after-purchase actions of Buyer, including without limitation, any injury, disability or death of workers or employees caused by or in any manner incurred because of the misuse, abuse, or modification of Goods by Buyer after delivery. BUYER’S OBLIGATION HEREUNDER IS IN NO WAY LIMITED BY ANY PROTECTION AFFORDED IT UNDER WORKERS’ COMPENSATION ACTS, DISABILITY BENEFITS ACTS, OR OTHER EMPLOYEE BENEFITS ACTS. GOVERNING LAW. The validity, interpretation and performance of this contract of sale and all claims of any kind whether in contract, tort or otherwise, concerning, arising or relating hereto, shall be governed by the laws of the State of Connecticut, excluding such State’s conflict of law principles
